This is to give notice as follows that in connection with the Petition for acceptance of the final appeal announced in the “Notice Regarding Petition for Acceptance of Final Appeal” dated February 12, 2015, Fuji Heavy Industries Ltd. (FHI) confirmed that the Supreme Court has issued an order.

2. Background of Judgment
In connection with lawsuit brought by FHI against the Government of Japan over claims of the balance of the initial investment fees associated with the AH-64D combat helicopter for the Japan Ministry of Defense, as announced in the “Notice of Court Ruling in Connection with Lawsuit (Appeal Court)” dated January 29, 2015, the Tokyo High Court in its appeal ruling upheld in almost all respects the claims of FHI.
Thereafter, as announced in the “Notice Regarding Petition for Acceptance of Final Appeal” dated February 12, 2015, the Government of Japan, as the appellee in the above-mentioned lawsuit, has filed a petition for acceptance of final appeal with the Supreme Court of Japan.(Case No.915)

3. Details of Supreme Court Order
(1) The court does not accept case No.915 as the final appellate court.
(2) Costs for filling the final appeal and the petition for acceptance shall be borne by the appellant.
